The following General Terms and Conditions apply to all business relationships in distance and away business between microgreenbox gmbh, hereinafter referred to as “microgreenbox”, and the customers. Due to the easier readability, the masculine form will be used for both genders in the future. Fridge Grow is a brand name used by microgreenbox gmbh. Therefore, microgreenbox gmbh is responsible for all products, documents or actions of Fridge Grow.

Conclusion

By placing an order in our online shop, the customer submits a binding offer for the purchase of the goods in the shopping cart. The purchase contract is only concluded by a confirmation from microgreenbox. microgreenbox reserves the right to cancel orders without giving reasons. If payments have already been made to microgreenbox at this time, they will be transferred back. In the case of a purchase in the online shop with delivery, the customer receives a notification by e-mail after the conclusion of the contract. A contract is only concluded by our express declaration of acceptance. Customers are obliged to fill in the fields (or information) provided in the order form completely and truthfully. microgreenbox reserves the right to change the content of the respective service offer at any time.

Ownership

The goods sold by microgreenbox to the customer remain the property of microgreenbox until the purchase price has been paid in full.

Delivery area

Orders placed via the online shop can be delivered within EU countries. Additional countries will be listed on the website.

Delivery period

microgreenbox delivers to any address in the EU, either by freight forwarder or by parcel service. For freight forwarder deliveries, the terms and conditions of the commissioned freight forwarder apply. microgreenbox will send the customer at least a written request to the e-mail address provided by the customer. The customer is responsible for the correctness of the data provided, microgreenbox has no obligation to investigate. Small consignments are delivered to the customer by parcel service. The delivery time varies depending on the country of delivery. As a rule, the delivery time is between 3-14 working days, whereby Saturday does not count as a working day. For parcel deliveries, it is not possible to select a delivery date and delivery window during the ordering process.

Delivery

The actual delivery costs incurred are shown in the order overview before the order process is completed when the postcode is entered. In the case of shipping to a third country (outside the EU), the amount of the shipping costs incurred must be inquired about before completing the order. If the customer chooses shipping to a delivery address specified by him as the delivery method, the shipping costs that are displayed in the webshop for the goods and when paying for the goods are to be borne by him. If the goods are entrepreneurs, then the delivery of the goods is at your risk.

Prices

The prices quoted by microgreenbox are gross sales prices. The price includes the statutory sales tax.

Payment

All invoice amounts are payable without deduction, unless otherwise agreed in writing. Until the invoice amount has been paid in full, all rights to the services provided remain the property of microgreenbox.

Maturity

Payments are due within fourteen (14) days of receipt of the invoice without further deductions. An objection to the services and prices stated in the invoice will only be accepted within this payment period. If you do not have this, please transfer the amount due to

Only the payment methods displayed to the customer during the ordering process will be accepted. We reserve the right to limit the selection of payment methods in individual cases. The data entered may be stored by the respective payment provider. In the case of pre-orders, the goods will not be shipped until we have received the entire payment amount. If you are in default with your payments, we reserve the right to charge you those reminder fees that were necessary for the appropriate collection or collection of the claim.

Availability of goods

If the goods you ordered are not available at short notice at the time of ordering, we will inform you of this. Cancellation policy and return

Customers have a right of withdrawal of 14 days. Returns are possible under certain conditions and subject to a fee, unless microgreenbox has an error.

Complaints

Products can only be returned if they were purchased directly from the online store. Contact is required before return.

Warranty

Legal warranty regulations apply. Compensation for consequential damages is excluded, unless it is a consumer transaction.

Limitations

microgreenbox is only liable for intent and gross negligence (except in the case of personal injury). The content of external links is not subject to the liability of microgreenbox.

Information about the ordering process

Via the shopping cart, the customer begins the step-by-step process to complete the ordering process. At the end of the ordering process, the customer is taken to collect the customer, invoice and delivery data that we need for future performance of the contract. If the customer has already created an account, the customer can also register for it at this point and thus use the address data already entered earlier.
Before completing the ordering process, we ask the customer to read our General Terms and Conditions and to confirm their acknowledgement by activating the corresponding checkbox before the customer completes the order and thus submits a binding offer to microgreenbox. Of course, it can always happen that mistakes are made when entering data. If the customer has made a mistake in the entry, we ask you to inform us immediately by sending a message to the e-mail address stored in the imprint, so that we can react as soon as possible. If the customer wants to cancel an order, we ask the customer to contact us by e-mail. Final provisions

The place of jurisdiction is Freistadt/ AUSTRIA.
Clients from Luxembourg and Switzerland expressly waive the reservations made by their states in this context and acknowledge the place of jurisdiction of Freistadt (or the nearest location) and the jurisdiction agreement without reservation. Austrian law applies to the contractual relationships. The applicability of the UN Convention on Contracts for the International Sale of Goods is generally excluded. Should individual provisions of the contract with the customer, including these General Terms and Conditions, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.

Cancellation

Right of withdrawal for consumers

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his self-employed professional activity.

Withdrawal

You have the right to withdraw from this contract within fourteen days without giving reasons.

The withdrawal period is fourteen days from the day on which

  • on which you or a third party designated by you who is not the carrier has taken possession of the goods, provided that you have ordered one or more goods under a single order and these are or will be delivered uniformly, or
  • on which you or a third party designated by you who is not the carrier has taken possession of the last goods, if you have ordered several goods under a single order and they are delivered separately, or
  • on which you or a third party designated by you, who is not the carrier, has taken possession of the last partial shipment or piece, if you have ordered goods that are delivered in several partial shipments or pieces, or
  • on which you or a third party designated by you, who is not the carrier, took possession of the first goods, provided that you have entered into a contract for the regular delivery of goods over a specified period of time.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you withdraw from this contract, we shall reimburse you all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you; in no case will you be charged any fees for this repayment.

We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen day period.

You will bear the direct costs of returning the goods.

They only have to pay for any loss in value of the goods if this loss of value is due to handling of them that is not necessary to check the nature, characteristics and functioning of the goods.

Special regulations for freight forwarding goods (large equipment):

In the case of goods that cannot be returned by post or parcel service (forwarding goods), you must organise and handle the return transport yourself. To do this, the device must be packed securely against damage. Shipping via a freight forwarder must be organized by yourself. Depending on the freight forwarder, costs of up to EUR 200 (incl. VAT) may be incurred.
You must make the goods freely accessible in the shipping packaging available for return transport.
